What can be done when a landlord has not tried to re-rent?

If your landlord attempts to compel you to cover the remaining rent without trying to re-rent the space, you may send them a letter reminding them of their “duty to mitigate damages,” which includes making attempts to re-rent the space. If this is ineffective, you will need to show proof of your landlord failing to make reasonable efforts to re-rent the space.
