What are the penalties for a person 18 years of age or older in State College with less than 8 grams of Hash or Hashish and is smoking-using it in a public space (a street, alley, park, sidewalk, a vehicle in or upon any street, alley, park or parking area, or any other place to which the public is invited)?

The penalty for smoking hash in State College or using a small amount of marijuana in the form of hash in a public space in State College is a non traffic summary citation with a $350 fine. The small amount must be less then 8 grams of hash in order to be considered a small amount and fall into the city citation. State College City Code § 1-1053-1054

Police enforcement do not have to enforce this law. This law only applies to State College city limits. Police can choose to enforce State and Federal penalties if they choose.
